Sugiko Malaysia Sdn. Bhd. (Company No.: 1115801-U) (hereinafter referred to as “SUGIKO”) and Toyo Engineering & Construction Sdn. Bhd. (Company No.: 152170-T) (hereinafter referred to as “TOYO”) agree theto the following contents to settle the loss charge issue for the TOYO offsite account whichthat was taken over from CNI Engineering & Construction Malaysia Sdn. Bhd. (Company No.: 761238-M) (hereinafter referred to as “CNIEC”).

As mentioned above, SUGIKO will charge RM 1,897,097.72 for the loss charge of the TOYO offsite account. After discussion between SUGIKO and TOYO, SUGIKO have agreed to give a special discount for the loss charge as below.

Discount Amount: RM 715,927.83

For your information, this amount is the equivalent amount of the total rental charge amount for returned material from 1st November 2018 to each return date.

Therefore SUGIKO will charge the following Final Charge Amount to TOYO to settle the loss charge issue of the TOYO offsite account.
1) Total Loss Charge: RM 1,897,097.72
2) Special Discount: RM 715,927.83
3) Total Charge Amount with Discount: RM 1,181,169.89 ….(3) = (1) – (2)
