By serving as an interpreter for the study visit of the court delegation of the Republic of Korea, I saw that the court delegation of the Republic Korea was very interested toin examineing America’s jury trials in criminal cases. Through the discussion between judges, I learned that Korea started a similar system in 2008 called “Citizen Participation Trial”, but in this system, the jury’s opinion does not have any binding power toward the judge’s final decision and has only an advisory effect. Even though Korean Jjudges were very fond of the United State’s jury trials and processes, I learned that Korean judges worried that in many criminal cases, especially in sexual violence cases, the victim does not want a punishment fonr the defendant, or the victim does not want a jury trials in Korea. I learned that these concerns arose in many Asian cultures and communities,; victims are afraid to stand up and feel fescared and ashamed, even though they were victims of serious criminal cases.
