The goal of the work is to develop suggestions on the improvement ofimproving the legislation in the field of establishment of the origin of the child in the medical fertilization. The novelty of the work is determined by the statement of the problem and an attempt objectively to analyze the legal norms, governing the origin of the child in the medical fertilization, by using the cryopreservedcryo-preserved sex cells. In order to protect the rights and interests of husband and wife and, most importantly , the interests of children, the law should provide a special rule, or to. Abstract (Jurkevich) The article considers the issue of the status of the court in the procedural evidence within the frameworks of the civil and procedural law. The different opinions, expressed in the scientific literature about the consideredthis issue are analyzed. The article examines the importance of the court as the subject of the evidence and the development of trend of the volume of its powers.
